Terms and conditions

THESE GENERAL CONDITIONS OF SALE (HEREINAFTER NAMED GENERAL CONDITIONS) HAVE BEEN DRAFTED AND PREPARED IN OBSERVANCE AND IN COMPLIANCE WITH THE PROVISIONS CONTAINED IN THE LEGISLATIVE DECREE. 206/2005 (HEREINAFTER CONSUMER CODE) AND IN THE LEGISLATIVE DECREE. 70/2003 (IMPLEMENTATION OF DIRECTIVE 200/31/EC RELATING TO CERTAIN LEGAL ASPECTS OF SOCIETY SERVICES, INFORMATION, PARTICULARLY ELECTRONIC COMMERCE IN THE INTERNAL MARKET); THEY ARE GENERAL IN SCOPE AND MAY SUBJECT CHANGES MADE NECESSARY BY SUBSEQUENT PROVISIONS OF LAW AND REGULATIONS.

These General Conditions represent the integrity of the relationships between retrogamestation.it (hereinafter referred to as RETROGAMESTATION.IT) and the Customer with reference to the purchase of products and services on the site.

In the event that any of the provisions contained in these General Conditions should be considered invalid, they will remain valid and effective for the remaining part.

The Customer is required, before submitting his purchase order, to carefully read these General Conditions. The forwarding of the purchase order implies full knowledge and express acceptance of the aforementioned General Conditions, as well as full and express knowledge of the information provided to him pursuant to the articles. 52 and 53 of the Consumer Code.

Furthermore, by accepting these General Conditions, the Customer exempts RETROGAMESTATION.IT from any liability deriving from the issuing of incorrect tax documents due to errors relating to the data provided by the Customer when placing the online order.

RETROGAMESTATION.IT does not sell or offer its services to minors under the age of eighteen.

1. Ownership of the Site

1.1 Pursuant to art. 52 co. I, letter. a) of the Consumer Code, the Customer is made aware that the website https://www.retrogamestation.it (hereinafter site) is owned by and is aimed at the sale of products and services online.
1.2 Even partial reproduction of the retrogamestation.it catalog is prohibited.

2. Prices

2.1
The prices expressed in Euros constitute an offer to the public and include VAT.
2.2 If prices are not indicated in the order form, the price indicated in the price list will be considered valid.

3. Purchase method

3.1
 The Customer can only purchase the products present in the RETROGAMESTATION.IT electronic catalog at the time of placing the order and viewable online at the address (URL) https://www.retrogamestation.it/, as described in the relevant information sheets.
3.2 The products delivered may not correspond exactly to those represented in the images accompanying the descriptive sheets of each product, since these representations have a purely illustrative function. The product purchased may therefore not correspond perfectly to that shown in the relevant data sheet as it may differ in colour, size, accessory products, without prejudice to the essential characteristics of the goods.

4. Orders

4.1
 RETROGAMESTATION.IT accepts orders for delivery in Italy, Europe as well as the rest of the world. Pursuant to art. 12 co I letter e) of the Legislative Decree. 70/2003, RETROGAMESTATION.IT informs the Customer that the contract can be concluded in the Italian language.
4.2 Orders can be placed directly online via the RETROGAMESTATION.IT website using the shopping cart function.
4.3 There is neither a minimum nor a maximum purchase amount.
4.4 Pursuant to art. 12 co. I lit. c) Legislative Decree 70/2003, the Customer is informed that, in the event of an error in entering the data, before submitting the order, he can modify them by accessing the MY ACCOUNT area where he will find the modify personal data function .
4.5 In the event that the Customer wishes, during the order and before its completion, he will be able to modify the contents of the cart via the shopping cart function.

5. Acceptance of the general conditions of sale and information aimed at concluding the contract

5.1
 The contract stipulated between RETROGAMESTATION.IT and the Customer must be considered concluded with the acceptance of the order by RETROGAMESTATION.IT communicated via e-mail.
5.2 . By sending the order, the Customer declares to have read all the information provided to him during the purchase procedure and to have read and fully accepted these General Conditions.
5.3 Once the online purchase procedure has been successfully completed, it will be the Customer's responsibility to obtain a paper copy or save an electronic copy and in any case keep these General Conditions in compliance with the provisions regarding distance contracts in the articles. 52 and 53 of the Consumer Code.
5.4 Once the contract has been concluded, the Customer has the right to cancel the order by means of written communication to be sent by e-mail to the address: info@retrogamestation.it no later than the sending of the e-mail with which RETROGAMESTATION.IT notifies the carrier of the successful delivery.
5.5 For orders already processed, the Consumer Customer may exercise the right of withdrawal in accordance with the law.
5.6 Right to refuse order management and/or shipment: RETROGAMESTATION.IT may exercise the right to refuse order management or shipment if the customer in any way damages the image or reputation of RETROGAMESTATION.IT itself. By way of example, this can happen in the following cases: insertion of negative reviews by the customer before receiving the ordered product or the product sent for processing or repair; inserting messages on your Facebook page that are offensive or harmful to the company's image; publication of harmful or denigrating posts against the company itself; etc. In this case, in the case of a product ordered on the RETROGAMESTATION.IT website, the company itself will be responsible for canceling and refunding the total paid for the order. In the case of products sent for processing or repair, it will be the company's responsibility to stop the processing or repair, at whatever point it has reached, remove all the components used for the repair and send the unrepaired or unworked product back to the customer, proceeding with the reimbursement of the amount provided for in the relevant order.

6. Delivery and shipping

6.1
Unless the Customer intends to collect the purchased goods personally at the premises of RETROGAMESTATION.IT, the latter will arrange for the shipment according to the following provisions in the shortest possible time and in any case no later than 60 (sixty) days from the moment of conclusion of the contract .
6.2 When completing the order, it is the Customer's responsibility to indicate the chosen carrier (post or courier); in this case it will be necessary to agree with RETROGAMESTATION.IT the times and methods of delivery of the goods.
In the event that the Customer fails to indicate the carrier, the latter accepts that RETROGAMESTATION.IT, as his agent, will proceed with the shipment via Courier ' while completing the order and before completing it.
6.3 Upon collection of the product from the premises of RETROGAMESTATION.IT by the carrier, the goods are considered delivered.
6.4 Shipping costs are in any case borne by the Customer, even if the latter makes use of the right of withdrawal, or refuses delivery or sends the ordered goods back to the sender.
6.5 Delivery abroad: any additional costs due to taxes or duties provided for by the legislation in force in the country of destination of the goods are also borne by the Customer. RETROGAMESTATION.IT will not be liable for any damages resulting from delays due to detention at the Customs Offices.
6.6 Delivery of the purchased product will be made at street level.
6.7 Upon delivery of the goods, it will be the Customer's responsibility to check that:
– the number of packages delivered corresponds to that indicated in the transport document;
– the packaging is intact, and, more precisely, that it is not damaged, wet or in any case altered even in the closing materials (adhesive tape or metal straps).
6.8 It will be the Customer's responsibility to immediately notify the carrier of any damage to the packaging and/or to the product or in the event of a mismatch in the number of packages delivered compared to those purchased by placing written control reservation on the delivery receipt.
6.9 Once the delivery receipt has been signed, the Customer will not be able to make any objection regarding the external characteristics of what was delivered.
6.10 In case of failure to collect the goods within and no later than 10 days - variable depending on the chosen carrier -, due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the contract will be considered terminated by law pursuant to and for the purposes of art. 1456 cc and the product will be delivered again to RETROGAMESTATION.IT; terminated the contract, RETROGAMESTATION.IT will proceed to refund the amount paid by the Customer, minus the costs of unsuccessful delivery of the product, the costs of returning it to RETROGAMESTATION.IT as well as any other possible expense in which it is incurred due to non-delivery. The termination of the contract and the refund amount will be communicated to the Customer by e-mail.

7. Payment methods

7.1 Pursuant to art. 52 lett. e) of the Consumer Code, the Customer acknowledges and accepts that payments can be made by choosing one of the methods indicated below:
MARK ON DELIVERY. Payment must be made in cash upon delivery of the goods. In the event that the Customer has opted for this payment method, he will have the possibility to cancel the order no later than upon receipt of the e-mail with which RETROGAMESTATION.IT will notify him of the successful delivery to the carrier .
CREDIT CARD . Payment can be made using cards belonging to the following circuits: Visa, Mastercard, American Express, PostePay.
PAYPAL . Payment can be made using PAYPAL online payment method.
7.2 By choosing to use this payment method, together with the conclusion of the online transaction, the relevant banking institution will authorize the commitment only of the amount relating to the purchase made. The amount relating to the shipped goods will actually be charged to the Customer's credit card only when the goods are shipped.
7.3 In the event of withdrawal by the Customer or cancellation of the order, RETROGAMESTATION.IT will simultaneously request the cancellation of the transaction with consequent release of the committed amount.
7.4 Since the release times depend exclusively on the banking system, once the transaction has been canceled, in no case RETROGAMESTATION.IT can be held responsible for any damages, direct or indirect, caused by the delay in the failure to release the amount committed by the banking system.
7.5 In the event that the Customer's order is processed beyond the maximum authorization limit, RETROGAMESTATION.IT will still charge the Customer's credit card with the amount due, even if in advance of the shipment of the goods.
7.6 RETROGAMESTATION.IT reserves the right to request additional information from the Customer (e.g. telephone number); the delivery terms will start from the date of receipt of the requested documentation.
7.7 At no time during the purchase procedure will RETROGAMESTATION.IT be aware of the information relating to the buyer's credit card transmitted via a protected connection directly and exclusively to the website of the banking institution that will manage the transaction. No computer archive of RETROGAMESTATION.IT will retain such data. Under no circumstances can RETROGAMESTATION.IT be held responsible for any fraudulent or undue use of credit cards by third parties when paying for products purchased on its sites.

8. Advance Payment

8.1 In case of payment by advance bank transfer, it will be the Customer's responsibility to send an email to info@retrogamestation.it no later than 7 (seven) days from the order to RETROGAMESTATION.IT. The order will be sent only after verification of the actual crediting of the sum due to the current account of RETROGAMESTATION.IT.
8.2 In the event that payment is not confirmed within the indicated deadline, the contract will be considered legally terminated pursuant to and for the purposes of the art. 1456 cc
8.3 The reason for payment must include:
– the order reference number;
– the date of placing the order;
– name and surname of the order holder.

9. Billing

9.1 By accepting these General Conditions, the Customer expressly agrees that the invoice may be sent and/or made available in electronic format.
9.2 The invoice will be issued automatically when the goods are shipped. To this end, it is essential to communicate your VAT number or tax code at the time the order is placed.
9.3 For issuing the invoice, the information provided by the Customer at the time of the order is valid. It will not be possible to make any changes to the invoice after it has been issued.

10. Refund and issuing of purchase vouchers

10.1 Even following the sending of the e-mail referred to in point 5.1, cases of partial unavailability of the goods may occur. In this case, RETROGAMESTATION.IT will contact the Customer via e-mail in order to agree on the possibility of sending the available products anyway or proceeding with the refund/issuance of a purchase voucher.
10.2 In the event that the Customer does not communicate whether he intends to receive a refund or a purchase voucher, for orders of an amount lower than 60 euros (VAT included), RETROGAMESTATION.IT will proceed with issuing a purchase voucher, while proceeding to reimbursement for higher amounts.
10.3 In the latter case the refund will be made no later than 60 days from the date of receipt of the communication indicated.
10.3.1 The purchase voucher will be usable for subsequent orders for an amount equal to that of the accrued credit. In this case it will be sufficient for the Customer to place a new order by indicating his credit and the number of the previous order from which it derives in the notes section; RETROGAMESTATION.IT will offset this credit from the next order.
10.4.1 In case of payment by credit card or Postepay card (usable exclusively with credit card mode), RETROGAMESTATION.IT will refund the amount no later than 60 days from the date of cancellation of the order, via cancellation payment and credit back to the Customer's credit card.
10.4.2 In case of payment by bank transfer, it will be the Customer's responsibility to communicate the IBAN code as well as the data of the holder of the bank account in favor of which to make the transfer to the e-mail address amministrazione@retrogamestation.it, in order to allow the RETROGAMESTATION.IT to arrange the bank transfer for the refund of the canceled order. Also in this case, the refund of the amount will be made via bank transfer, no later than 60 days from the date of cancellation. As soon as the refund is made, the Customer will receive an e-mail containing confirmation of the success of the operation and the date of the crediting currency of the same.
10.5 The provisions of this article also apply in the event of cancellation of the order referred to in point 5.4 of these General Conditions.

12. Right of withdrawal

12.1 The Consumer Customer has the right to withdraw from the contract stipulated remotely without any penalty and without specifying the reason within 14 (fourteen) days, pursuant to art. 52 of Legislative Decree 206/200505 (Consumer Code).
12.2 The Customer who intends to exercise this right must send, within 14 (fourteen) days starting, in the case of service contracts, from the day of conclusion of the contract, in the case of sales contracts, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the goods, a registered letter with acknowledgment of receipt. Alternatively, within the same deadline, you can send an e-mail to info@retrogamestation.it, or by filling out the online form available on the site, by accessing the personal area MY ACCOUNT, provided that the desire to withdraw is confirmed within the following 48 (forty-eight) hours by registered letter with acknowledgment of receipt. The aforementioned registered letter must be sent to the following address: Retrogamestation C/o Speedy srl, via A. Manzoni n.28, 63074 San Benedetto del Tronto (AP). In particular, it must contain:
– the expression of willingness to take advantage of the benefits granted by law and more precisely the right of withdrawal;
– the indication of the product subject to withdrawal;
– the invoice number if already issued or, failing that, the number indicated in the transport document delivered by the carrier;
– data relating to the Customer's bank or postal account.
12.3 To obtain a refund of the fee, within a maximum period of 14 (fourteen) days from the date of receipt of the customer's wish to withdraw from the purchase, it will be the customer's responsibility to send to the sender, by post or courier, the product in relation to which you intend to exercise the right of withdrawal together with any sales invoice.
12.4 Within 14 (fourteen) days of receiving the communication with which the Customer expresses his desire to exercise the right of withdrawal, RETROGAMESTATION.IT will provide the refund by credit card transfer, bank transfer or bank transfer postal. The aforementioned refund refers exclusively to the price of the product; in any case the additional shipping and home delivery costs will not be refunded and will remain the responsibility of the Customer, as provided for in the paragraph. III of the art. 67 of the Consumer Code.
12.5 The right of withdrawal is in any case subject to the following conditions: - the right applies to the product in its entirety; as it is not permitted to use the same limited to a part of the product (by way of example, accessories, attached software); - pursuant to art. 55 co II letter d) of the Consumer Code, the right does not apply to audiovisual products or sealed computer software (including those attached to hardware material) once removed from their packaging; the purchased good must be intact and not damaged in any way and returned in the original perfectly sealed packaging, complete with all its parts (including, but not limited to, packaging as well as any documentation and accessory equipment such as manuals)
12.6 Pursuant to the co. II of the art. 67 of the Consumer Code, the substantial integrity of the goods to be returned is an essential condition for exercising the right of withdrawal. As long as the goods have not arrived again at the premises of RETROGAMESTATION.IT following certification of receipt by said Company, any damage to the goods will be charged to the Customer; in the event of damage to the goods delivered to the carrier, it will be the responsibility of RETROGAMESTATION.IT to notify the Customer (within five working days of receipt of the goods at its premises) to allow the same to promptly take action against the carrier. In this case, RETROGAMESTATION.IT will return the damaged goods to the Customer and simultaneously cancel the withdrawal request.
12.7 The Customer will not be able to exercise the right of withdrawal in cases where RETROGAMESTATION.IT ascertains:
– the lack of the external packaging and/or the original internal packaging;
– the absence of constituent elements of the product such as, but not limited to, accessories, cables, manuals, parts.
12.8 In the cases described above, RETROGAMESTATION.IT will proceed with returning the purchased goods to the Customer, charging the shipping costs incurred to the same.

13. Product warranty

13.1 All products sold by RETROGAMESTATION.IT come with a warranty with the exception of wearable parts such as controllers and external peripherals (joystsick, mice, keyboards, lightguns, steering wheels). In order to benefit from warranty assistance, the Customer must keep the invoice or delivery receipt.
13.2 The rules set out in the articles apply to the Consumer Customer. 128 and following of the Legislative Decree. 206/2005, therefore, it will be the Customer's responsibility to report any faults and defects in the product to RETROGAMESTATION.IT no later than the deadline of two months from the discovery of the fault itself. This report must be made by registered mail to the address: Retrogamestation c/o Speedy srl, via A. Manzoni n.28, 63074 San Benedetto del Tronto (AP). It will also be the Customer's responsibility to send the product in the original packaging to the aforementioned location, complete with all its parts (including packaging and any documentation and accessory equipment such as, but not limited to, manuals, cables).
13.3 This guarantee applies to the product that presents a lack of conformity, provided that it has been used correctly, in compliance with its intended use and as provided in the attached technical documentation.
13.4 Pursuant to art. 130 of the Consumer Code, in the event of a lack of conformity, RETROGAMESTATION.IT will, without any charge to the Customer, restore the conformity of the product through repair or replacement or reduce the price until the contract is terminated .
13.5 If the defect does not consist of a lack of conformity, the Customer will bear any costs of verification and restoration incurred by RETROGAMESTATION.IT.
13.6 Without prejudice to the above, for products guaranteed directly by the manufacturer the guarantee will be provided according to the methods illustrated inside the product packaging. Therefore in such cases the Customer will be able to report any faults and defects of the product directly to the manufacturer and send the product to the authorized Assistance Centre.

14. Authorization to replace defective components

14.1 Following the purchase of a repair service, the customer authorizes RETROGAMESTATION.IT, in the event that the piece or mechanism covered by the service is not repairable, to replace the same piece with a new one, without the need to carry out no prior authorization request from the customer and with consequent charging of the related additional cost on the invoice.

15. Failure to collect the goods from the premises of RETROGAMESTATION.IT

15.1 In case of purchase and failure to collect products and/or services or in case of failure to pay a repair supplement within 7 days of the conclusion of the contract, even following return due to storage by the express courier, the Customer will be required to pay the storage costs of the item itself, established at 1 euro per day plus VAT for the first seven days of non-collection and at 3 euros per day + VAT starting from the eighth day onwards.
15.2 The same will happen in the event of failure to collect the products on which repairs or modifications have been requested, in which case the 7-day period will start from the date of communication of availability for collection sent by e-mail from RETROGAMESTATION.IT or from the date of shipment to the customer.

16. Legal notes

16.1 By accessing this site you agree that the laws and regulations of the Italian State will apply to all matters relating to the use of this site.
16.2 All trademarks present on the site are registered by their respective owners; we also inform you that unauthorized use of the same will be prosecuted in accordance with the law.

17. Applicable legislation

17.1 The sale of products on the site is regulated by Legislative Decree. 6 September 2005 n. 206 (Consumer Code) regarding distance selling and by Legislative Decree. 9 April 2003 n. 70 regarding electronic commerce for contracts concluded by the Consumer Customer.

17.2 For contracts concluded by those who purchase the products for purposes relating to their professional activity, the rules on the sales contract provided for in the articles apply. 1470 et seq. of the Civil Code.

18. Court of jurisdiction

For any and all disputes relating to the interpretation, execution and termination of the contract, the Court of Ascoli Piceno will be exclusively competent except in the case of a contract with a Consumer Customer; in this case the Court of the place where he has residence or domicile if located in the territory of the Italian State will be exclusively competent.

19. Cookies

RETROGAMESTATION.IT uses cookie technology to improve and simplify the User's access to the Website www.retrogamestation.it
Cookies are a small amount of data that are stored in the computer's RAM or hard drive each time a website is visited. The Site uses cookies to recognize and track visitors, in order to provide them with faster access to the Site and to modify its contents based on preferences. Cookies do not in any way allow the visited site to have access to any other data present on the users' computer.
Cookie files are sent to the user's computer in order to uniquely identify it and record information
personal preferences of the same together with other technical information. The cookies used by RETROGAMESTATION.IT are configured into two types:
a) Permanent cookies (they remain on the computer until they are deleted);
b) Temporary cookies (they are deactivated when you close the browser);
Cookies do not contain or reveal personal data. Any personal information forwarded via the retrogamestation.it website may be linked to the data stored in cookies.

Unfair clauses

Pursuant to and for the purposes of the articles. 1341 and 1342 of the Civil Code, the Customer, after having carefully and specifically read it, expressly approves and accepts the following clauses:
